Washington, D.C. - Judicial Confirmation Network counsel Wendy E. Long today made the following statement regarding the vacancy President Bush will fill on the U.S. Supreme Court:
"The recent decisions of the Supreme Court underscore why public opinion polls show respect for the Court is sliding. For 30 years or so, the Court has on the one hand been disrespecting our rights as spelled out plainly in the Constitution, and on the other hand making up things that are not in the Constitution at all.
"Bare majorities on the Court have recently held that local governments can seize people's homes and turn them over to wealthy developers, that a courthouse must rip the 10 Commandments down from its walls, and that international and foreign law should dictate U.S. Supreme Court decisions instead of following our own U.S. Constitution.
"These latest decisions just pile on to the sorry line of judicial rulings handed down nationwide, including many others by the Supreme Court itself, doing things like prohibiting school prayer, allowing the burning of the American flag, mandating same-sex marriage, protecting 'virtual' child pornography on the Internet, upholding discriminatory racial preferences, taking the words "under God" out of the Pledge of Allegiance, striking down states' modest restrictions on late-term abortions.
"The Republican base, which worked hard to elect President Bush twice, does not think the Supreme Court should be stuck in the mentality of the 1960s, which has proven so destructive to the rule of law and respect for our American institutions. Liberal groups now arguing for 'balance' on the Court and the appointment of a 'moderate' Justice just want to keep the Supreme Court on a leftward march, away from the Constitution. When the people speak through their elected representatives on political and policy matters, as they are entitled to do in our representative democracy, the liberal Left runs to the courts to implement opposite policies through judicial tyranny.
"President Bush thinks Americans deserve better from their Supreme Court. That's why he promised to nominate judicial conservatives like Justice Scalia and Justice Thomas, who will respect the Constitution, democracy and the limited role of the Court to act as a neutral umpire in our society."
